A. A utility innovation is defined as “any implement, tool, product or process which is of practical utility by reason of it’s form, configuration, construction or composition.

Q. What is the difference between a patent and a utility innovation?
A. A utility innovation does not have to satisfy the requirement of inventiveness as required for a patent. As such any invention which fails the examination of a patent application on the basis of the requirement may alternatively have the invention registered as a utility innovation.

Q. What is the procedure for making an application for a Certificate of Utility innovation?
A. The procedure is very much the same as the making of an application for a patent.

Q. What is the duration of a Certificate of Utility Innovation?
A. The term of the Certificate is for 5 years from the date of grant.

Q. What are the rights attached to a grant of a Certificate of Utility Innovation?
A. The rights are the same as attached to an award of a patent.
